In many countries, a Notary or “Notary Public” is an official who is authorized by the State to verify the authenticity of signatures or documents, and to witness the sworn statements or affidavits of persons. Notarization of documents is often required as a proof of their authenticity. However, as Thailand has not yet joined the Hague Convention on Legalization of Foreign Public Documents, there are no offices of “Notary Public” in Thailand. Instead, Thailand has “Notarial Services Attorneys” (NSA’s) who are trained, certified and licensed by the Lawyers Council of Thailand to perform similar functions as a “Notary Public” for documents that are to be used locally, abroad or at foreign embassies in Thailand.
The Lawyers Council of Thailand is the governing body of all lawyers in Thailand and it regulates the practice of notarial services in the country. Notarial Services Attorneys are required to have a special seal and an individual registration number issued by the Lawyers Council of Thailand. They can certify signatures, document copies, translations, and facts that are signed or presented before them. They can also prepare affidavits, declarations, oaths, and objections for the use of foreign authorities or courts. Generally, signatures are witnessed simply by the NSA applying his or her NSA stamp and signing accordingly. Authentication of documents is performed via the provision of a notarial certificate featuring the full stamp and gold seal of the Notarial Services Attorney (an example of which can be seen in the image adjacent to this paragraph).
In some cases, formalities might require the document to be to notarize at the Embassy of the country to which the document is to be presented. In which case the Embassy of that country will often facilitate the process.
